Over the last 34 years, Judge DeMarco has been involved in the legal system in a number of different capacities: a prosecutor, trial lawyer, corporate counsel and a sitting judge. Throughout his judicial tenure, his contributions to jurisprudence, court administration and the community have earned him significant recognition. Keep reading to learn more about his qualifications and accomplishments.



Judge DeMarco was admitted to practice law in New York State in 1985 and began his career as a prosecutor at the Monroe County District Attorney’s Office.  After three years, he entered into private practice where he spent the majority of his career (20 years) as a partner at the law firms of Hodgson-Russ and Phillips-Lytle in the litigation/trial practice groups concentrating in the areas of business litigation and white collar criminal defense.  He also served as Town Attorney for Irondequoit between 1993 and 2000.

Judge DeMarco’s judicial career began in Irondequoit Town Court where he was twice elected and served from 2001 to 2009.  He was elected to the Monroe County Court bench in 2009 and a year later was appointed as Acting Supreme Court Justice.  In January 2014, Judge DeMarco took over as lead judge of the Rochester Treatment Courts and in 2016 he was appointed as the Treatment Court Supervising Judge for the 7th Judicial District. 

As a Monroe County Court Judge, he has presided over a thousand criminal cases, including hundreds of violent felony offenses and approximately 50 homicides.  Additionally, Judge DeMarco has decided dozens of local court appeals and post-conviction motions.  

Judge DeMarco was appointed to serve as an Acting Supreme Court Justice and in that capacity he has handled numerous civil cases expeditiously and equitably, including, but not limited to, landlord tenant disputes, guardianship proceedings, civil confinement petitions, sex offender registration classifications, name change applications, pistol permit applications and revocations, default judgments, matrimonials and adoptions.

As the Supervising Judge of the Treatment Courts for the 7th Judicial District, Judge DeMarco has been integral in expanding, and presiding over, some of the most reputable and high volume courts in the State.  The Rochester Treatment Courts are a national model that have been recognized as the gold standard of best practice to other communities looking to establish or improve their Treatment Courts.

Judge DeMarco has by choice devoted half of his first term in County Court to addressing the opioid crisis not only in Rochester and Monroe County but throughout the eight-county 7th Judicial District.  He has personally presided over the Felony Drug Courts (Judicial Diversion Program, DWI Court and Veterans Treatment Court) and has played an instrumental role in the successful transitioning of literally hundreds of people from addiction to recovery.  Because of his experience, he was tasked by the Administrative Judge on behalf of the Chief Judge of the State of New York to spearhead the creation of an Opioid Court/Stabilization Part of the Rochester City Courts.​
